Notice to Injured Workers Regarding Guarantee Insurance Company

 

On November 27, 2017, the state of Florida placed Guarantee Insurance Company and its affiliates in receivership because the company appeared to be insolvent. Pursuant to Virginia law, Virginia workers’ compensation claims for accident dates through November 27, 2017 will be transferred to the Virginia Property and Casualty Insurance Guaranty Association. Because the transfer of claims administration is complex, and pursuant to Virginia law, on Friday December 15, 2017 the Virginia Workers’ Compensation Commission issued an Order staying all judicial and claims administration activities involving Guarantee Insurance Company for thirty (30) days. On Tuesday, January 16, 2018, the Commission issued an Order extending the stay for an additional thirty (30) days. The Commission will re-evaluate the Stay Order at the expiration of this additional thirty-day period. In the meantime, the Commission is offering Alternative Dispute Resolution services to provide information and facilitate resolution of claims.
